Survey and Certification Requirements for The Merchant Shipping (Prevention of Air Pollution from Ships) Regulations 2008 - additional guidance

1. Introduction
1.1 Section 1 of MGN 381 (M+F) “Survey and Certification Requirements for The Merchant Shipping (Prevention of Air Pollution from Ships) Regulations 2008” provides guidance on the survey and certification requirements.
2. Clarification of the term “important repair”
2.1 Section 1.1.(iii) of MGN 381 states:
“an additional survey after a repair resulting from an investigation following an accident to the ship or when a defect is discovered in a ship, either of which substantially affect the integrity of the ship or the efficiency or completeness of the equipment of the ship. An additional survey is also required after an important repair or renewal is made.”
2.2 In cases of doubt as to whether a repair or renewal is important ship owners or masters are recommended to seek advice from the MCA (however such advice from the MCA will not be a definitive ruling because that can only be given by an arbitrator or the courts).
